Receivership & Insolvency
The digital estate is often the most valuable asset.
When a court appoints a receiver or an assignee takes control of a distressed business, the digital record is often the most valuable - and most vulnerable - asset in the estate. E-Hounds provides forensic and eDiscovery services purpose-built for receivership, ABC, and insolvency matters.
Overview
Work from day one through court-approved billing.
E-Hounds has served as the forensic and eDiscovery vendor of record on major receivership matters in the Middle District of Florida, working with court-appointed receivers on SEC, CFTC, and FTC-initiated cases, and on state-court assignments for the benefit of creditors.
Our engagements have included multi-year matters with quarterly court-approved billing, large-scale hosted review platforms supporting simultaneous multi-party access, and time-sensitive forensic responses to asset freezes. We understand the unique demands of receiver-controlled matters: court reporting obligations, the fee application process, the need for detailed and auditable billing, and the importance of working efficiently within a constrained estate.
Service Scope
What a receiver engagement typically includes.
Forensic preservation and acquisition
Rapid response to secure digital evidence at the moment it matters, often within days of a receiver appointment or asset freeze. Enterprise servers, workstations, laptops, mobile devices, and cloud accounts - both on-site and remote. Chain-of-custody documented for court.
Email and cloud collection
Gmail, Google Vault, Microsoft 365, Exchange, and legacy platforms. From a handful of custodians to enterprise-wide collections. Data delivered in formats ready for attorney review.
Server retrieval and long-term custody
Located, retrieved, and forensically preserved servers that had been in commercial storage for years - assessing what is there, imaging it, and returning it to the estate for sale, disposition, or continued review.
Hosted eDiscovery review
Document review hosted in-house on iConect for receiver's counsel, enforcement teams, and co-counsel. We have simultaneously hosted separate, isolated review environments for multiple parties on the same matter - including SEC enforcement and the receiver's team working independently on the same underlying data.
Expert testimony and court filings
Expert declarations, technical affidavits, and live testimony in support of receiver motions. Assistance drafting and reviewing technical content for court submissions.
Fraud forensics support
Investment fraud, Ponzi schemes, and financial crimes: keyword searches, communications analysis, trading record review, and structured data exports for counsel and agency review.
Sensitive Matters
Healthcare and patient-data insolvencies.
We have worked with assignees in healthcare insolvencies to preserve and facilitate access to patient records, including sudden-closure matters involving hundreds of thousands of patient files. Our on-premise platform lets us handle PHI without exposing it to third-party cloud vendors.
